Welcome to Mintail! These Terms of Service ("Terms") govern your use of the Mintail mobile application (the "App") operated by MyAppDesk ("we", "us", or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Description of Service

Mintail is a portfolio tracking application that allows users to monitor their assets, track price changes, and view portfolio snapshots over time. The App offers a freemium model: basic features are free, with premium features (including AI-powered insights) available through a PRO subscription.

Important: Mintail is a tracking and monitoring tool only. We do not provide financial advice, investment recommendations, or trading capabilities.

2. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you should review these Terms with a parent or guardian.

3. Account and Data

To use the App, your portfolio data is stored locally and/or synced to our servers. You are responsible for:

• The accuracy of the portfolio information you enter.
• Maintaining the security of your device.
• All activities associated with your data.

We reserve the right to suspend or terminate access for accounts that violate these Terms.

4. Subscription and Payments

4.1 Freemium Model

The App is free to download and use with basic portfolio tracking features. Premium features, including AI-powered portfolio insights, require a PRO subscription.

4.2 Subscription Terms

• Subscriptions are managed through RevenueCat and processed via the App Store (iOS) or Google Play Store (Android).
• Subscription fees are billed in advance on a recurring basis (monthly or annually, depending on your selected plan).
• You can manage or cancel your subscription through your device's app store settings.

4.3 Refunds

Refund policies are governed by the respective app stores (Apple App Store or Google Play Store). We do not process refunds directly.

5. User Data

5.1 Your Data

You retain ownership of the portfolio data, asset configurations, and preferences you create using the App ("User Data"). By using the App, you grant us a limited license to store and process your User Data solely for the purpose of providing the service.

5.2 Data Accuracy

You are solely responsible for the accuracy of the portfolio data you enter. We are not responsible for any errors, losses, or decisions made based on inaccurate data entry.

6. Important Disclaimers

6.1 Not Financial Advice

THE APP IS A PORTFOLIO TRACKING TOOL ONLY. Nothing in the App constitutes financial, investment, legal, or tax advice. The information displayed, including asset prices, portfolio values, and AI-generated insights, is for informational purposes only.

6.2 No Investment Recommendations

We do not recommend, endorse, or advise on any particular investment, asset, or financial strategy. Any decisions you make based on information from the App are made at your own risk.

6.3 AI-Powered Insights

The AI-powered insights feature (available to PRO subscribers) uses artificial intelligence to analyze portfolio data and provide observations. These insights:

• Are for informational and educational purposes only.
• Should not be relied upon as financial advice.
• May contain errors or inaccuracies.
• Do not constitute a recommendation to buy, sell, or hold any asset.

6.4 Price Data

Asset prices displayed in the App are obtained from third-party data providers and are updated periodically (daily or multiple times per day). We do not guarantee the accuracy, completeness, or timeliness of price data. Always verify important financial information through official sources.

7. Intellectual Property

7.1 Our Property

The App, including its design, features, code, graphics, and branding, is owned by MyAppDesk and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the App without our prior written consent.

7.2 Feedback

If you provide us with feedback or suggestions, you grant us the right to use such feedback without any obligation to compensate you.

8. Prohibited Uses

You agree not to:

• Use the App for any unlawful purpose.
• Attempt to gain unauthorized access to the App or its systems.
• Interfere with or disrupt the App's functionality.
• Use automated systems (bots, scrapers) to access the App.
• Circumvent any security measures or subscription restrictions.
• Resell or redistribute access to the App.
• Use the App to provide financial advice to others.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, secure, or error-free.
• The asset prices or portfolio values displayed will be accurate or timely.
• The AI-powered insights will be accurate, complete, or suitable for any purpose.
• Any defects in the App will be corrected.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MYAPPDESK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

SPECIFICALLY, WE SHALL NOT BE LIABLE FOR ANY FINANCIAL LOSSES, INVESTMENT LOSSES, OR DAMAGES ARISING FROM:

• Reliance on information displayed in the App.
• Decisions made based on AI-powered insights.
• Inaccurate or delayed price data.
• Your use of the App for investment decisions.

Our total liability for any claims arising from your use of the App shall not exceed the amount you paid for the subscription in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless MyAppDesk, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the App or violation of these Terms.

12. Termination

12.1 By You

You may stop using the App at any time. To delete your data, contact us at team@myappdesk.dev.

12.2 By Us

We may suspend or terminate your access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App will immediately cease.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Effective Date" at the top of this page. Your continued use of the App after changes constitutes acceptance of the new Terms.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Spain and the European Union. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of Spain.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MyAppDesk regarding your use of the App.
