Terms of Service

Welcome to ACNH Guide! These Terms of Service ("Terms") govern your use of the ACNH Guide mobile application (the "App") operated by MyAppDesk ("we", "us", or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Description of Service

ACNH Guide is an unofficial, fan-made companion app for the video game Animal Crossing: New Horizons. It provides offline reference data (critters, fossils, art, villagers, songs, recipes, and more), checklists to track your in-game collection progress, and related tools.

The App is free to download and use. It contains no advertising and no in-app purchases.

2. Not Affiliated with Nintendo

ACNH Guide is not affiliated with, endorsed by, sponsored by, or approved by Nintendo. Animal Crossing: New Horizons and all related names, characters, images, audio, and assets are trademarks and copyrights of Nintendo Co., Ltd. and their respective owners.

Game content shown in the App is included for identification and reference purposes only, as a fan work. If you are a rights holder and believe content in the App should be removed, contact us at team@myappdesk.dev and we will respond promptly.

3. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you should review these Terms with a parent or guardian.

4. Your Data and Content

4.1 Local Storage

Your collection progress, checklists, passport details, profile avatar, and settings are stored only on your device. You retain full ownership of anything you enter into the App.

4.2 No Backup Guarantee

We do not back up your data. Uninstalling the App, resetting its data, or losing your device will permanently erase your progress. You are solely responsible for your own backups.

5. Accuracy of Information

Game data in the App is compiled from publicly available community sources and may be incomplete, outdated, or inaccurate. The App is a reference aid only and is not a substitute for the game itself. We make no guarantee that any data, timing, price, or availability shown matches your game version.

6. Intellectual Property

6.1 Our Property

The App's original design, code, layout, and MyAppDesk branding are owned by MyAppDesk and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the App without our prior written consent.

6.2 Third-Party Property

All Animal Crossing game assets remain the property of their respective rights holders, as stated in Section 2.

6.3 Feedback

If you provide us with feedback or suggestions, you grant us the right to use such feedback without any obligation to compensate you.

7. Prohibited Uses

You agree not to:

• Use the App for any unlawful purpose.
• Attempt to gain unauthorized access to the App, our asset servers, or related systems.
• Interfere with or disrupt the App's functionality.
• Use automated systems (bots, scrapers) to access the App or its asset servers.
• Extract, redistribute, or resell the App's assets, data, or access to the App.
• Remove or obscure any attribution or disclaimer shown in the App.

8. Availability and Changes

The App works offline, but images and audio are downloaded from our servers. We may modify, suspend, or discontinue the App or any of its features, including the asset servers, at any time and without notice.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, secure, or error-free.
• The game data displayed will be accurate, current, or complete.
• Any defects in the App will be corrected.
• Your locally stored data will be preserved.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MYAPPDESK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

11. Indemnification

You agree to indemnify and hold harmless MyAppDesk, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the App or violation of these Terms.

12. Termination

12.1 By You

You may stop using the App at any time by uninstalling it from your device.

12.2 By Us

We may suspend or terminate your access to the App at any time, with or without cause, with or without notice.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Effective Date" at the top of this page. Your continued use of the App after changes constitutes acceptance of the new Terms.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Spain and the European Union. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of Spain.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MyAppDesk regarding your use of the App.
