Welcome to Elara! These Terms of Service ("Terms") govern your use of the Elara mobile application (the "App") operated by MyAppDesk ("we", "us", or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Description of Service

Elara is a daily affirmations and wellbeing application. It offers affirmations you can read, listen to, and save, mood logging, breathing exercises, vision boards, an optional AI companion chat, and text-to-speech playback, including a neural voice that runs on your device. The App works without account registration, and your personal content is stored locally on your device. Premium features are available through in-app purchases.

2. Not Medical or Professional Advice

Elara is a wellbeing and self-reflection tool. It is not a medical device and does not provide medical, psychological, or therapeutic advice, diagnosis, or treatment. The affirmations, mood insights, breathing exercises, and AI companion chat responses are for informational and motivational purposes only. They are not a substitute for professional care. If you are experiencing a mental health crisis or have concerns about your health, please seek help from a qualified professional or your local emergency services.

3. AI-Generated Content

The companion chat uses a third-party artificial intelligence service (Google Gemini) to generate responses. AI-generated content may be inaccurate, incomplete, or inappropriate despite our safeguards. You are responsible for how you use and act on any AI-generated content. Do not rely on it for medical, legal, financial, or other professional decisions.

4. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you should review these Terms with a parent or guardian.

5. In-App Purchases and Subscriptions

5.1 Free and Premium Features

The App is free to download and use with basic features. Premium features are available through in-app purchases and subscriptions.

5.2 Payment Terms

• In-app purchases are managed through RevenueCat and processed via the App Store (iOS) or Google Play Store (Android).
• Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
• You can manage and cancel subscriptions through your device's app store settings.

5.3 Refunds

Refund policies are governed by the respective app stores (Apple App Store or Google Play Store). We do not process refunds directly.

6. Your Content

Content you create in the App, including saved affirmations, mood entries, vision boards, and voice recordings, is stored locally on your device. You retain full ownership of your content. Because it is stored only on your device, we cannot recover it if you delete it or uninstall the App; you are responsible for any backups.

7. Intellectual Property

7.1 Our Property

The App, including its design, features, code, graphics, affirmation content, and branding, is owned by MyAppDesk and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the App without our prior written consent.

7.2 Feedback

If you provide us with feedback or suggestions, you grant us the right to use such feedback without any obligation to compensate you.

8. Prohibited Uses

You agree not to:

• Use the App for any unlawful purpose.
• Attempt to gain unauthorized access to the App or its systems.
• Interfere with or disrupt the App's functionality.
• Use automated systems (bots, scrapers) to access the App.
• Circumvent any security measures or purchase restrictions.
• Resell or redistribute access to the App.
• Use the companion chat to generate harmful, abusive, or illegal content.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, secure, or error-free.
• AI-generated responses will be accurate, appropriate, or reliable.
• Any defects in the App will be corrected.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MYAPPDESK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

11. Indemnification

You agree to indemnify and hold harmless MyAppDesk, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the App or violation of these Terms.

12. Termination

12.1 By You

You may stop using the App at any time by uninstalling it from your device.

12.2 By Us

We may suspend or terminate your access to the App at any time, with or without cause, with or without notice.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Effective Date" at the top of this page. Your continued use of the App after changes constitutes acceptance of the new Terms.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Spain and the European Union. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of Spain.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MyAppDesk regarding your use of the App.
